Terms of service

Terms of
service.

Last updated:

These terms cover the Calmduck website and our dashboards and internal tools. Client work is also governed by the agreement with your organisation.

1. About Calmduck

Calmduck is owned and operated by Durian Trading Pty Ltd in Australia. In these terms, “we”, “us” and “our” mean that company.

Contact us at help@calmduck.co.

2. Client agreements

We agree the scope, fees, responsibilities and delivery arrangements with each client.

If these terms conflict with your organisation’s service agreement, that agreement takes precedence, subject to rights that the law protects.

This page does not add charges or change an existing client agreement.

3. Access and acceptable use

Private client tools are for users authorised by the client. Only use accounts, systems and data you have permission to access.

Keep your sign-in details secure. Tell your organisation or us if you suspect unauthorised access.

Do not bypass access controls, interfere with services, introduce malicious software or use the tools for unlawful purposes.

4. Hosting and support

Your team can run its own service, or Calmduck can manage it for you.

We agree where the service runs and who handles hosting, updates, backups, security and support for each engagement.

Support hours, response times and other service commitments depend on that agreement.

5. Your data and our work

Your organisation retains its rights in its data. Giving us access to provide a service does not transfer those rights.

Only provide data that you have permission to use and share. Your organisation controls access to its data and connected accounts.

We use client data to provide the agreed service and follow the client’s instructions, subject to legal duties.

Our privacy policy explains how we handle personal data, including Google sign-in details.

Ownership and licences for custom code, designs and other deliverables are agreed with the client.

Existing rights in Calmduck materials and third-party materials stay with their respective owners.

6. Google and other providers

Where Google sign-in is available, it helps confirm your identity. Signing in does not give access beyond the permissions granted by your organisation.

Third-party services can have their own terms and availability limits. These terms do not replace those providers’ terms.

7. Results and availability

Our dashboards and tools support your decisions. Check important results against the source information before acting on them.

Maintenance, connection problems or provider outages can interrupt a service. Any availability commitments are set out in the client agreement.

Tell us about errors or service problems so we can address them under the agreed support arrangements.

8. Protecting access

We may restrict affected access when reasonably necessary to address a security risk, unlawful use or a legal requirement.

We will limit the restriction to what is needed and notify your organisation as soon as practical, unless the law prevents this.

We will work with your organisation to resolve the issue and restore access when it is safe and lawful.

Ending a service, returning data and deleting records follow the client agreement and applicable law.

10. Changes and contact

We may update this page and its date when our services or requirements change.

Updates do not retrospectively change existing client agreements. Changes to those agreements follow their agreed process and applicable law.
